Unified Terms of Use

Ultimate Drop Down Menu is an original creation and is protected by national and international copyright law. It is not open-source or public domain software. By downloading and using the script you confirm that you have read and agreed to the following terms of use:

I: Commercial Use

• 1. For the purpose of this license the term "one website" means the site of a single person or organisation, that is, conceptually one site - a single site may have multiple entry points or be hosted on more than one server, or conversely one domain might host a number of different sites.
• 2. You may use the script on one website per license bought, which is built, owned or maintained by yourself, or on behalf of a third-party, subject to the terms and exclusions of this license.
• 3. You may not further redistribute, sell, or offer it for download, in any form or on any medium, whether for profit or not, without the author's express written permission. This includes, but is not limited to: adding it to script archives, including it in online or downloadable web templates, or bundling and distributing it with other scripts/software.
• 4. You agree to preserve the comments and copyright notices in all component scripts and stylesheets.
• 5. You agree not to use the script on illegal sites, or on pages which contain illegal material. The terms of this agreement shall be governed by the jurisdiction of the license holder, therefore you may not use the script at all in jurisdictions where this agreement is itself illegal, or where you are not empowered to enter into such an agreement.
• 6. You guarantee not to hold the author responsible for any problems you may encounter, whether directly, indirectly or not at all caused by your use of this menu script.

II: Unlimited Commercial Use

• 1. You may use the script on any number of websites which are built, owned or maintained by yourself, or on behalf of a third-party, subject to the terms and exclusions of this license.
• 2. You may not further redistribute, sell, or offer it for download, in any form or on any medium, whether for profit or not, without the author's express written permission. This includes, but is not limited to: adding it to script archives, including it in online or downloadable web templates, or bundling and distributing it with other scripts/software.
• 3. You agree to preserve the comments and copyright notices in all component scripts and stylesheets.
• 4. You agree not to use the script on illegal sites, or on pages which contain illegal material. The terms of this agreement shall be governed by the jurisdiction of the license holder, therefore you may not use the script at all in jurisdictions where this agreement is itself illegal, or where you are not empowered to enter into such an agreement.
• 5. You guarantee not to hold the author responsible for any problems you may encounter, whether directly, indirectly or not at all caused by your use of this menu script.

III: Non-Profit / Non-Commercial Use

• 1. For the purpose of this license the word "revenue" is used to describe monetary, service or commodity income of any kind. This includes, but is not limited to, income from sales, promotion, licensing, premium or paid-for content, marketing, advertising, sponsorship or other affiliate programs.
• 2. You may use the script on non-commercial websites subject to the terms, definitions and exclusions of this license. For the purpose of this license, "non-commercial websites" are defined as:
  • a. personal or hobby sites which generate no revenue;
  • b. websites owned and maintained by a charitable or not-for-profit organisation; this includes websites of registered charities where the principal activity is fundraising;
  • c. websites owned and maintained by a school, college or other educational institution; this includes private schools;
• 3. You may not use the script on commercial websites without first obtaining a commercial use license. For the purpose of this license, "commercial websites" are defined as:
  • a. any site which is built, owned or maintained by a profit-making person or organisation, even if the site itself doesn't generate any revenue; unless it falls into category 2(c) above;
  • b. any site which does generate revenue, even if it's otherwise non-commercial; unless it falls into category 2(b) above;
  • c. government, government-agency or political-party websites; unless they fall into category 2(c) above;
  If you wish to use the menu for a commercial website as defined above, you must purchase a license for commercial use. You cannot agree to these terms on behalf of a third-party - if your own interest in the site is in any way commercial (for example, a freelancer being paid to build it) then a commercial license is always required, even if the site is for a non-commercial organisation.
• 4. You may not redistribute, sell, or offer it for download, in any form or on any medium, whether for profit or not, without the author's express permission. This includes, but is not limited to: adding it to script archives, giving it to third-parties (such as clients of a web-designer or agency), including it in online or downloadable web templates, or bundling and distributing it with other scripts/software.

• 5. You must place a visible link from your website back to this one on every page which is using the UDM4 drop down menu. You can either use one of these images, or a text link in the following format:

• 6. You agree to include this copyright notice in the HTML source code of each web page which uses the script:

IV: Affiliate Program

• 1. UDM4 and PB Educational Services will make resonable effort to accurately track all referrals, however, you agree and acknowledge that certain technological considerations may prevent PB Educational Services from accurately tracking and recording referrals. Such considerations include, but are not limited to: a visitors configuration such as blocking cookies, network failure, and other circumstances.
• 2. All referral payments will be made within a reasonable time frame after the last day of each month. PB Educational Services Inc will usually process all payments within 15 days after the last day of the preceeding month, however this is not a guaranteed timeframe.
• 3. Minimum Payment amount is $50.00 (USD) for US affiliates, $100.00 (USD) for non-US affiliates.
• 4. Non-US affiliates are subject to a $10.00 processing fee for each payment.
• 5. Referral Fees will be 20% of the applicable order price after any discounts, coupons, or other reductions are applied.
• 6. Clicks from referral links will be tracked and maintained for a period of 30 days.

V: Unlimited Commercial Use - Subscription License

• 1. You may use the script on any number of websites which are built, owned or maintained by yourself, or on behalf of a third-party, subject to the terms and exclusions of this license.
• 2. You may not further redistribute, sell, or offer it for download, in any form or on any medium, whether for profit or not, without the author's express written permission. This includes, but is not limited to: adding it to script archives, including it in online or downloadable web templates, or bundling and distributing it with other scripts/software.
• 3. You agree to preserve the comments and copyright notices in all component scripts and stylesheets.
• 4. You agree not to use the script on illegal sites, or on pages which contain illegal material. The terms of this agreement shall be governed by the jurisdiction of the license holder, therefore you may not use the script at all in jurisdictions where this agreement is itself illegal, or where you are not empowered to enter into such an agreement.
• 5. You guarantee not to hold the author responsible for any problems you may encounter, whether directly, indirectly or not at all caused by your use of this menu script.
• 6. Upon cancellation of your subscription you surrender any and all rights to use this script. You must either a) discontinue use of the code on every site which uses this license or b) purchase a single site license for every site which uses this license or c) purchase an unlimited site license. We may, at our sole discretion, reduce the amount due for options b and c by the amount already paid to PB Educational Services Inc.
• 7. Cancellation requests must be sent in writing via email to info@pbeducationalservices.com. Cancellations must be received at least 10 business days prior to the next scheduled payment.
• 8. No refunds, full or partial, will be issued for monthly payments.
